STANDARDS – UK’s NAJ publishes new guidance on design replication and intellectual property

The UK’s National Association of Jewellers (NAJ) has released a new guidance note on Design Replication and Intellectual Property, providing practical advice to help jewellery businesses understand, respect, and protect intellectual property (IP) rights across the design, manufacture, and retail process.

The guidance highlights the range of legal protections available to jewellery designs, including copyright, design rights, and trade marks, while emphasising that there is no single, straightforward rule to avoid infringement. Instead, it encourages businesses to adopt a proactive and informed approach to IP management throughout the supply chain.

Developed to support NAJ members and the wider trade, the document aims to help businesses operate legally, ethically, and professionally, while reducing the risk of costly disputes, reputational damage, and potential liability. It provides practical, actionable steps for due diligence, including conducting IP searches, documenting design development, verifying suppliers, and seeking early legal advice to help ensure originality before production begins.

The guidance also outlines how businesses can better protect themselves by avoiding inadvertent copying, demonstrating ownership of their designs, and responding appropriately if disputes arise.

“This guidance has been developed to help businesses navigate what can often be a complex and misunderstood area of law. There is no simple checklist to guarantee that a design won’t infringe someone else’s rights, but by taking sensible, well-documented steps and embedding due diligence into day-to-day operations, businesses can significantly reduce their risk. Just as importantly, they can strengthen their own position by clearly evidencing the originality and ownership of their designs.”

The new guidance note forms part of the NAJ’s wider commitment to supporting members with intellectual property matters. This includes its partnership with IP specialists, the National Business Register, and the Association’s established free design deposit scheme, Copywatch, which helps jewellery businesses protect and evidence their creations.
